Enforcement Division

Introduction The Enforcement Division was established on 17 April 1972 under the Ministry of Trade and Industry (MTI) with the objective of helping the government to curb inflation at that time. On October 27, 1990, the Ministry was restructured to form two ministries namely the Ministry of International Trade and Industry (MITI) and the Ministry of Domestic Trade and Cost Of Living (KPDN). The Enforcement Division was placed under KPDN which is now known as theMinistry of Domestic Trade and Cost Of Living (KPDN). Implementing the Festive Season Maximum Price Scheme (SHMMP) under the Price Control and Anti-Profiteering Act 2011 to protect consumers from traders who seek to take advantage by selling controlled items above the prescribed prices during festive seasons. Combating the leakage of subsidized controlled goods and stabilizing the supply of essential goods to ensure their availability in the market under the Control of Supplies Regulations 1974 and the Control of Supplies Act 1961. Investigating consumer complaints under enforced laws to ensure a healthy and ethical business environment. Eradicating unethical business practices to protect consumers from exploitation by traders under the Hire Purchase Act 1967, Weights and Measures Act 1972, Direct Sales and Anti-Pyramid Scheme Act 1993, Consumer Protection Act 1999, and Trade Descriptions Act 2011, including activities such as misleading sales promotions, door-to-door sales, hire purchase agreements, verification of weighing and measuring instruments, and the use of halal labeling. Issuing permits for scheduled controlled goods under the Control of Supplies Act 1961 for the distribution of controlled items. Protecting intellectual property rights under the Trade Marks Act 2019, Copyright Act 1987, Geographical Indications Act 2022, and Patents Act 1983 to ensure exclusive rights for intellectual property ownership in Malaysia or internationally for works eligible for copyright protection, including literary works, films, music, sounds, art, brands, trademarks, geographical indications, and patent ownership. Promoting good trade practices by prohibiting false trade descriptions and misleading statements regarding the supply of goods and services under the Trade Descriptions Act 2011.
